Early Access Terms of Service

Please read these Early Access Terms of Service ("Terms") carefully before registering for or participating in the Three Dee Farm Early Access Program. By submitting your information for early access, you agree to be bound by these Terms.

1. Early Access Program Overview

The Three Dee Farm Early Access Program ("Program") is designed to provide eligible users with limited access to the Three Dee Farm platform ("Platform") before its general availability, along with potential promotional benefits as described in our early access marketing materials.

1.1 No Guaranteed Access. Submission of an application for the Program does not guarantee acceptance or participation. Three Dee Farm reserves the sole and absolute right to determine eligibility for the Program and may accept or reject applications at its discretion without providing reasons.

1.2 Limited Availability. The Program may be limited by time, geography, feature availability, or other factors as determined by Three Dee Farm.

1.3 Beta Status. You acknowledge that the Platform provided during the Program is in a beta or pre-release state and may contain bugs, errors, or other issues which may affect functionality and user experience.

2. Eligibility and Account Requirements

2.1 Age Requirement. All participants must be at least 18 years of age to register for and participate in the Program.

2.2 Compliance with Laws. Users must comply with all applicable laws and regulations within their respective jurisdictions. Three Dee Farm is not responsible for any user's failure to comply with local, state, federal, or international laws applicable to their use of the Platform.

2.3 Email Verification. Participation in the Program is strictly limited to individuals who register using the same email address provided during the early access application process. You agree to provide accurate and current email information, as this will be our primary means of communication.

2.4 One Account Policy. Each eligible participant may maintain only one account under the Program.

2.5 Account Continuity Requirement. Early access benefits, including any promotional credits or special pricing, are tied to the continuous existence of the account created during the early access period. If you delete your account for any reason, all early access benefits will be permanently forfeited, even if you later create a new account using the same email address.

2.6 Non-Transferability. Early access status, benefits, and promotional credits are non-transferable and cannot be assigned to any other person or account.

2.7 Data Retention. Your early access data will be retained for one (1) year following the Platform's General Availability date, after which it will be permanently deleted unless you choose to transition to our standard service. 3. Early Access Benefits

3.1 Promotional Credits. Eligible participants may receive promotional credits as specified in our marketing materials. These credits are subject to the following terms:

• Credits are earned only after meeting the specified spending threshold (currently $250).
• Credits may only be applied toward future purchases or services on the Platform.
• Credits have no cash value and cannot be redeemed for cash or transferred to other users.
• Credits will expire 12 months after issuance if not used.
• Three Dee Farm reserves the right to modify, suspend, or cancel promotional credits at any time.

3.2 Program Modifications. Three Dee Farm reserves the right to modify the benefits, requirements, or terms of the Program at any time without prior notice.

4. Termination and Program Changes

4.1 Program Duration. The Early Access Program is temporary in nature and will access to the program will conclude at Three Dee Farm's discretion, typically upon general availability of the Platform.

4.2 Termination by Three Dee Farm. Three Dee Farm may terminate your participation in the Program at any time, with or without cause and without prior notice.

4.3 Changes to Terms. Three Dee Farm may modify these Terms at any time by posting revised Terms on the Platform. Your continued participation in the Program after such changes constitutes your acceptance of the modified Terms.

4.4 Communication Opt-Out. You may opt out of non-essential communications at any time by contacting our support team at support@threedeefarm.com . Essential service-related communications may still be sent regarding your account administration.

4.5 Survival of Terms. The provisions regarding limitations of liability, intellectual property, and your obligations shall survive any termination of your participation in the Program.

5. Feedback and Confidentiality

5.1 Feedback. We welcome and encourage your feedback regarding the Platform during the Program. By providing feedback, you grant Three Dee Farm a perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, disclose, sublicense, distribute, modify, and otherwise exploit such feedback without restriction.

5.2 Confidentiality. As a participant in the Program, you may have access to confidential information, features, or materials not available to the general public. You agree to maintain the confidentiality of any information that is marked as confidential or that would reasonably be understood to be confidential.

6. Limitation of Liability

6.1 "As Is" Basis. The Platform provided during the Program is made available on an "as is" and "as available" basis, without warranties of any kind, either express or implied.

6.2 No Guarantees. Three Dee Farm does not guarantee that the Platform will meet your requirements, be uninterrupted, timely, secure, or error-free.

6.3 Limitation of Liability. To the maximum extent permitted by applicable law, Three Dee Farm shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your participation in the Program or use of the Platform during the early access period.

6.4 Jurisdictional Compliance. Three Dee Farm is not liable for a user's failure to comply with applicable laws and regulations within their respective jurisdiction. Users are solely responsible for ensuring their usage of the Platform complies with all local, state, federal, and international laws applicable to their circumstance.

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Virginia, without regard to its conflict of law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located within Hanover County, Virginia.
